1. Renter agrees to the following contractual obligations:
A. To use and occupy rental facilities itself, without assignment of its rights or deviation from the purposes described;
B. To inspect the premises prior to usage, and to call to the City’s attention, by a written notice, any defective or unsafe condition;
C. To inspect and re-inspect the rental facilities during the usage; to insure that no hazardous or defective conditions have arisen during usage; to correct any such conditions within its power and to notify the City, in writing of and such conditions it cannot correct;
D. To at all times manage and control its usage, and the activities and conduct of the patrons of its usage, to preserve their health and welfare;
E. To forbid any illegal or dangerous activities by Renter’s agents, members, or employees, or Renter’s patrons;
F. To safeguard City property, and leave rental facilities in the same condition of cleanliness and repair as at the inception of the term of this Agreement;
G. To assume all costs for damages that occur to the facility while in the care of the Renter;
H. To save, defend and hold harmless City from any and all liability caused by, contributed to, or in any way stemming from Renter’s usage of these premises.
2. This agreement is non-assignable
3. In the event that Renter is an unincorporated association, its signatory hereto agrees to accept personal responsibility for the correct execution of this Agreement.
4. Renter represents that it has procured all necessary licenses and permits for its activities under this Agreement, and that it will at all times during the term of this Agreement maintain any licenses required by City or any other agency having jurisdiction, and obey the ordinances of City and any other such agency during its lease.
